Welcome to Samui Unlocked (the "Platform", "we", "us" or "our"), available at samuiunlocked.com.

Samui Unlocked is an independent online business directory, local discovery platform and community information service focused on Koh Samui, Thailand. The Platform provides business listings, events, promotions, local updates, Marketplace services, Journal content, advertising opportunities and other related features.

These Terms and Conditions ("Terms") govern access to and use of the Platform, including services provided to visitors, registered users, businesses, advertisers and content contributors.

These Terms apply to visitors when using the Platform and to registered users and participating businesses when they expressly accept the applicable terms. The mere appearance of an independently created, unclaimed business listing does not mean the business has accepted these Terms or authorised promotional use of its materials.

1. Acceptance and Eligibility

These Terms apply to all users of Samui Unlocked, including visitors, business owners, authorised representatives, registered account holders, advertisers and contributors.

Users must comply with applicable laws and must provide accurate information when registering, submitting content or purchasing services.

Individuals acting on behalf of a business confirm that they have appropriate authority to manage the business's account, listing or commercial arrangements.

2. Platform Services

2.1 Complimentary Business Listings

Samui Unlocked provides complimentary business listings to help residents and visitors discover local businesses, services, attractions and activities across Koh Samui.

Complimentary listings may be created directly by businesses, submitted by authorised representatives or independently researched and published by Samui Unlocked using lawfully obtained information.

Businesses are not required to purchase a subscription, register an account or claim a listing to appear in the complimentary directory, subject to applicable law and individual rights.

Unclaimed business listings display the business or trading name only as business-specific information. Samui Unlocked does not publicly display an unclaimed business's description, address, location, contact information, website, social media links, opening hours, services, photographs, logos or other business-supplied or independently sourced details on its business listing.

Samui Unlocked may display its own generic branding, directory navigation, category headings and an invitation to request management access. Such Platform elements are not representations or endorsements by the business. Additional business information becomes eligible for public display only after an authorised representative has successfully claimed the listing and approved or supplied the information for publication, subject to our moderation and legal requirements.

Unclaimed listings may be held internally for directory administration and claim processing, subject to applicable privacy and data protection law. Internal collection does not mean the information will be made public.

The availability, format and functionality of complimentary listings may change as the Platform develops.

2.1A Listing Eligibility and Editorial Discretion

Samui Unlocked reserves the right, at its discretion, to decline, withhold, restrict, suspend or remove a business listing, claim request, account, advertisement, event, promotion or other submission. This includes circumstances involving suitability, relevance to Koh Samui, quality standards, accuracy, safety, suspected misrepresentation, legal or regulatory concerns, or the integrity and reputation of the Platform.

We are not obliged to accept or publish every business, and publication or prior approval does not guarantee continued inclusion. Decisions will be exercised lawfully, in good faith and consistently with applicable contractual commitments, consumer protections and non-discrimination requirements. Where an active paid service is materially affected, applicable refund or other contractual and statutory rights remain unaffected.

2.2 Paid Listings and Promotional Services

Samui Unlocked may offer optional paid services, including featured placements, premium advertising, promotional banners, enhanced business profiles, direct lead forms, Journal exposure, Marketplace packages and other promotional opportunities.

Pricing, duration, included features and applicable conditions will be communicated at the time of purchase or agreement.

Purchasing a paid service does not guarantee customer enquiries, sales, bookings, search engine rankings, website traffic or specific commercial results.

2.3 Events, Promotions and Updates

Businesses and authorised contributors may submit events, promotions, announcements and updates for publication.

Submitted information must be accurate, lawful and relevant to the stated business or event.

Event organisers and businesses remain responsible for the accuracy of dates, times, prices, availability, booking conditions, cancellations and other published details.

Samui Unlocked reserves the right to review, edit, reject, suspend or remove submitted content where reasonably necessary for accuracy, quality, safety, legal compliance or Platform integrity.

2.4 Marketplace and Third-Party Services

Samui Unlocked may provide Marketplace listings and facilities that allow businesses and individuals to promote products, services or opportunities.

Unless expressly stated otherwise, Samui Unlocked is not the seller, service provider, booking agent or contracting party for transactions between users and third-party businesses.

Any purchase, booking, agreement or transaction made directly with a listed business is subject to that business's own terms and conditions.

Users are responsible for conducting appropriate checks before entering into transactions with third parties.

3. Publicly Sourced Business Information

3.1 Information Sources

Samui Unlocked independently researches local businesses to maintain a useful and informative directory.

Where lawfully permitted, information may be collected, verified or compiled from publicly accessible sources, including:

• Official business websites.
• Public business social media pages.
• Public mapping and location services.
• Existing online business directories.
• Public advertisements and business announcements.
• Published promotional and marketing materials.
• Information supplied directly by business owners or authorised representatives.
• Other legitimate publicly accessible business information sources.

Public accessibility does not automatically establish permission to reproduce copyrighted materials or provide a lawful basis for processing personal data. Samui Unlocked aims to collect and use information only where permitted by applicable law.

3.2 Independently Created Listings

Some business listings are created independently by Samui Unlocked without direct registration or submission by the business concerned.

Such listings are intended to identify businesses by their trading names for public discovery and convenience. No additional business-specific information is displayed publicly unless the listing has been successfully claimed and its content supplied or expressly approved for publication.

The inclusion of a business does not imply that the business has:

• Registered with Samui Unlocked.
• Claimed or approved its listing.
• Entered into a commercial agreement with the Platform.
• Purchased advertising or promotional services.
• Endorsed, sponsored or partnered with Samui Unlocked.

Independently created listings may be identified as unclaimed or independently maintained. Unclaimed listings are informational directory entries and are not presented as business-approved advertisements or endorsements. Samui Unlocked does not rely on these Terms as consent from an unclaimed business.

3.3 Accuracy and Verification

Samui Unlocked makes reasonable efforts to provide accurate and useful information. However, information obtained from external sources may be incomplete, outdated or incorrect.

For claimed listings, we do not guarantee that all business details, opening hours, contact information, prices or services remain current.

Business owners and authorised representatives are encouraged to notify us of inaccuracies and may request corrections or removal.

For claimed listings, the business is responsible for the accuracy of information it submits or expressly approves. Samui Unlocked remains responsible for exercising reasonable care in its own editorial changes and Platform operations.

3.4 No Implied Endorsement

Publication of a business listing does not establish any agency, employment, partnership, sponsorship, endorsement or other formal relationship between Samui Unlocked and the listed business.

Samui Unlocked operates independently and does not represent itself as an official representative of businesses unless a separate agreement expressly provides otherwise.

4. Business Listing Claims, Corrections and Removal

4.1 Claiming a Business Listing

Business owners and authorised representatives may request access to manage an existing listing through the Platform's claim process.

Reasonable verification may be required to confirm authority and prevent unauthorised changes.

Verification may include confirmation through an official business email address, website, telephone number or other suitable evidence.

Claiming a listing allows access to applicable management features but does not transfer ownership of the Platform, its software or independently created content.

4.1A Business Claiming and Promotional Authorisation

By successfully claiming or registering a business listing and expressly accepting these Terms, the claimant confirms that they are the business owner or an authorised representative with authority to act on behalf of the business.

Upon such acceptance, the business authorises Samui Unlocked to publicly display, feature, advertise and promote the business using information, descriptions, photographs, logos, branding and other materials submitted or expressly approved by the business for publication.

This authorisation covers the following channels and activities reasonably connected with promoting the participating business or the Platform:

• The Samui Unlocked website, directory and associated Platform services.
• Official Samui Unlocked social media accounts and business spotlight features.
• Samui Unlocked newsletters, email campaigns and community communications, subject to applicable marketing and privacy rules.
• Search engine optimisation, search listings and digital advertising.
• Journal articles, editorial features, community updates and promotional publications.
• Other promotional channels operated by Samui Unlocked for substantially similar purposes.

The business grants Samui Unlocked a non-exclusive, royalty-free licence to reproduce, display, format, translate, adapt and distribute approved materials for these purposes. The business retains ownership of its intellectual property. Material adaptations must not materially misrepresent the business, its services or its offers.

The business confirms that information it submits or expressly approves is accurate and lawful, and that it has the necessary rights and permissions for the uses authorised above. The business is responsible for correcting submitted or approved information when it becomes outdated. This does not make the business responsible for inaccuracies independently introduced by Samui Unlocked.

Claiming a listing does not, by itself, constitute consent on behalf of individual employees, customers or other identifiable persons whose personal data may appear in business materials. Personal data will be handled in accordance with Section 9 and applicable law.

Businesses may request withdrawal of future promotional authorisation or removal of their listing under Section 4.3. Samui Unlocked will stop new promotional use of the relevant materials after processing a valid withdrawal request, subject to applicable legal obligations. Previously published third-party copies, shares and search caches may remain outside our control.

4.2 Corrections and Updates

Business owners and authorised representatives may request corrections to inaccurate or outdated information.

We will review reasonable requests and make appropriate changes where justified.

4.3 Listing Removal Requests

Businesses may request removal of their listing by contacting info@samuiunlocked.com.

Registration, payment or purchase of services is not required to submit a removal request.

We aim to acknowledge removal requests within three business days and complete straightforward verified removals within seven business days.

Where verification is reasonably necessary, we may request sufficient information to establish that the requester is the business owner or an authorised representative. We will not routinely require copies of personal identification documents where less intrusive verification is sufficient.

Requests involving personal data will be handled in accordance with applicable data protection laws and statutory requirements.

4.4 Removal from Search Engines

Once a listing is removed from Samui Unlocked, previously indexed versions may remain temporarily visible in third-party search engine results or caches.

Samui Unlocked does not control third-party search engine indexing or cache removal schedules.

4.5 Future Publication

Where a business has expressly requested that its listing not be published, Samui Unlocked will take reasonable measures to prevent unintended republication, subject to applicable legal obligations.

5. Business Accounts and Registration

Registered users are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their accounts.

Users must provide accurate registration details and promptly update information when necessary.

Accounts must not be transferred, shared or used to impersonate another individual or business without appropriate authorisation.

Samui Unlocked may suspend or restrict accounts where reasonably necessary to address suspected fraud, security threats, unauthorised access, abuse or violations of these Terms.

6. Paid Services, Billing and Renewals

6.1 Pricing and Payment

Paid services are offered at the prices and on the terms displayed or agreed at the time of purchase.

All applicable fees, billing periods and payment conditions will be communicated before a purchase is confirmed.

Services may be activated following successful payment or confirmation of an agreed payment arrangement.

6.2 Service Duration and Renewal

Subscription and advertising periods are determined by the purchased package or written agreement.

Where a service is eligible for renewal, Samui Unlocked may provide renewal notifications before expiry.

Unless automatic renewal has been expressly agreed and disclosed, renewal requires a new payment or confirmation.

Expired paid services may revert to complimentary functionality or be deactivated, depending on the service concerned.

6.3 Refunds and Cancellations

Refund eligibility depends on the purchased service, its delivery status, the agreed commercial terms and applicable law.

Where services have already been delivered or advertising has commenced, refunds may be limited to the extent permitted by law.

Nothing in these Terms excludes statutory consumer rights or other remedies that cannot lawfully be excluded.

6.4 Service Changes

Samui Unlocked may introduce, modify or discontinue Platform features as services evolve.

Where changes materially affect an active paid service, we will take reasonable steps to notify affected customers and provide an appropriate remedy where required by law or contract.

7. User-Generated Content

7.1 Content Responsibility

Users submitting content confirm that they have the necessary rights and permissions to publish that content and that it does not violate applicable laws or third-party rights.

Users remain responsible for their submitted descriptions, images, logos, videos, promotions, events, announcements and other materials. Businesses confirm that submitted or expressly approved materials may lawfully be used for the promotional purposes described in Section 4.1A, including publication on official Samui Unlocked social media channels. Responsibility for submitted content does not remove Samui Unlocked's own legal obligations.

7.2 Content Licence

By submitting content, users grant Samui Unlocked a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, format and distribute that content solely as reasonably necessary to operate, display and promote the relevant Platform services. For businesses that have expressly accepted Section 4.1A, this includes the promotional uses specified there.

This licence continues for as long as the content is published or reasonably required for lawful operational purposes, subject to applicable rights and obligations.

Users retain ownership of their original content.

7.3 Content Moderation

Samui Unlocked may review, edit, reject or remove content that is unlawful, misleading, abusive, infringing, fraudulent, inappropriate or otherwise inconsistent with these Terms, or that we otherwise decide not to host under Section 2.1A.

We are not obligated to publish every submission.

8. Intellectual Property and Third-Party Rights

8.1 Platform Ownership

The Samui Unlocked name, branding, original design, software, database structure, original editorial content and other proprietary Platform materials are protected by applicable intellectual property laws.

Except where expressly permitted, users may not copy, reproduce, redistribute, sell or commercially exploit proprietary Platform materials without authorisation.

8.2 Business Names, Trademarks and Images

Business names, trademarks, logos, photographs, videos and other third-party materials remain the property of their respective rights holders.

Reference to a business name or trademark for factual identification does not imply ownership, sponsorship or endorsement.

Samui Unlocked will use third-party creative materials only where authorised or otherwise permitted under applicable law.

8.3 Copyright Complaints

Rights holders who believe material published on Samui Unlocked infringes their intellectual property rights may contact info@samuiunlocked.com.

Complaints should identify the material concerned, its location on the Platform, the rights claimed and sufficient contact information for review.

We will review complaints and take appropriate action, including removal where warranted.

9. Privacy and Personal Data Protection

Samui Unlocked respects the privacy of users, business owners and individuals whose information may appear on the Platform.

Where information relates to an identifiable individual, including sole traders, named representatives, personal contact details or photographs, processing is subject to applicable privacy and data protection laws, including Thailand's Personal Data Protection Act (PDPA).

Depending on the circumstances, personal information may be processed for legitimate directory operations, account administration, communications, service delivery, legal compliance or other purposes supported by an applicable lawful basis.

Where consent is legally required, Samui Unlocked will seek the necessary consent.

Public availability of personal information does not automatically remove privacy obligations or establish a lawful basis for every use.

Individuals may exercise applicable rights concerning their personal data, including requests for access, correction, objection, withdrawal of consent where applicable, and erasure in circumstances provided by law.

10. Communications and Marketing

Samui Unlocked may communicate with businesses and registered users regarding their listings, account activity, service enquiries, purchased services and relevant operational matters.

Promotional emails and marketing communications will be sent only where permitted by applicable law and subject to relevant consent, notice and opt-out requirements.

Recipients may request that marketing communications cease by using an available unsubscribe mechanism or contacting us directly.

We will respect valid opt-out requests and maintain appropriate suppression records to prevent unwanted repeat communications.

11. Acceptable Use

Users must not:

• Submit false, misleading or fraudulent information.
• Impersonate businesses, individuals or Platform representatives.
• Publish unlawful, defamatory, threatening or abusive content.
• Infringe intellectual property or privacy rights.
• Attempt unauthorised access to accounts or systems.
• Distribute malware, malicious code or harmful material.
• Use automated systems to extract substantial Platform content without authorisation, except where permitted by law.
• Interfere with the security, operation or availability of the Platform.
• Use the Platform for unlawful commercial activities.

Samui Unlocked reserves the right to take proportionate action against violations, including restricting access, removing content or suspending accounts.

12. Business Compliance and Legal Responsibility

Businesses submitting or managing listings are responsible for ensuring their operations, advertisements, promotions and services comply with applicable laws and regulations.

Where relevant, this includes business registration, licensing, consumer protection, advertising, tax, immigration, employment and other legal requirements.

Publication of a business listing does not constitute certification, licensing, regulatory approval or verification of a business's legal status.

Samui Unlocked may cooperate with lawful requests from competent authorities where required or permitted by applicable law.

13. Third-Party Links and Services

The Platform may contain links to external websites, social media pages, booking services, payment providers and other third-party resources.

These services operate independently and may have their own terms, privacy policies and commercial conditions.

Samui Unlocked is not responsible for the content, availability, security or practices of third-party websites or services, except to the extent responsibility cannot lawfully be excluded.

14. Disclaimer and Limitation of Liability

Samui Unlocked provides directory and community information for general informational purposes.

While reasonable efforts are made to maintain useful and accurate information, we do not guarantee that all content will be complete, current, accurate or uninterrupted.

Users should independently verify important business information, prices, availability, safety requirements and service conditions before relying on them.

To the maximum extent permitted by applicable law, Samui Unlocked is not liable for losses arising solely from inaccurate third-party information, external service failures or transactions conducted independently between users and listed businesses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct or other non-excludable legal obligations.

15. Platform Availability and Maintenance

We aim to maintain reliable access to Samui Unlocked but cannot guarantee uninterrupted availability.

The Platform may occasionally be unavailable due to maintenance, technical problems, security updates, hosting issues or circumstances beyond our reasonable control.

We may temporarily restrict access where necessary to protect the Platform, its users or its data.

16. Brand Usage and False Representation

The Samui Unlocked name, logo and brand identity may be referenced by businesses for truthful promotional purposes, such as indicating that their business is listed on the Platform.

Such references must not falsely imply ownership, official partnership, sponsorship, endorsement, co-development rights or commercial affiliation.

Unauthorised or misleading use of Samui Unlocked branding may result in a request for correction, removal or other appropriate action under applicable law.

17. Changes to These Terms

Samui Unlocked may update these Terms to reflect changes in Platform functionality, services, operational requirements or applicable law.

The latest version will be published on this page with an updated revision date.

Where changes materially affect registered users or active paid services, reasonable notice will be provided where appropriate or legally required.

Continued use of the Platform following publication of updated Terms may constitute acceptance to the extent permitted by applicable law. Where new or materially expanded promotional authorisation requires affirmative agreement, Samui Unlocked will request express acceptance rather than treating silence or an unclaimed listing as consent.

18. Governing Law and Disputes

These Terms are governed by the laws of Thailand.

Disputes arising from the use of Samui Unlocked will be subject to the jurisdiction of the competent courts of Thailand, subject to any mandatory legal protections or jurisdictional requirements that apply.

Users and businesses are encouraged to contact us first so that concerns may be addressed promptly and reasonably.
